FAIR FLY is represented by

1. Right of use, termination of use

FAIR FLY is a prepaid service whose right of use comes into effect upon payment of an advance invoice, unless otherwise stipulated in the specific order process. FAIR FLY reserves the right to refuse payment in individual cases and to refuse the right of use. Upon payment of the advance invoice, the site operator receives the usage options of the respective current FAIR FLY version on https://fair-fly.de for flight sites which are directly licensed to him or which he may use on the basis of a cooperation agreement with the site owner.

2. Responsibility of site operator

The site operator assures and ensures that the sites operated by him or used in cooperation are operated or used in accordance with the legal requirements. The responsibility for information and data concerning the respective sites lies exclusively with the site operator. Within the scope of his responsibility as a site operator, the site operator assures to check these regularly for their validity and to ensure that flight safety is guaranteed.
FAIR FLY reserves the right to temporarily or permanently deny the use of FAIR FLY to the site operator in the event of a violation or concrete suspicion of a violation and to withhold any invoice amounts paid in advance.

3. Confidentiality and data protection

FAIR FLY treats the data provided by the site operator confidentially. All data will be protected in accordance with the law and will be deleted or destroyed if not used. By using FAIR FLY, the site operator confirms to have a binding data protection statement in which the storage of personal data of third parties (club or guest pilots) is regulated according to DSGVO and to make it accessible to them. The site operator must ensure that the access data provided to him by FAIR FLY is not made accessible to unauthorized third parties. FAIR FLY shall not be liable for any damage caused by insufficient protection of the access data. FAIR FLY reserves the right to give information in case of misuse or suspicion of misuse as far as FAIR FLY is requested to do so by authorities, courts or persons.

4. Remuneration, billing and price changes

Billing is based on the FAIR FLY price list valid at the time. Price increases shall be announced with one month’s notice and shall not be applicable retroactively. Separate agreements may be made for special services.

5. Liability

All parties involved are aware of the fact that a hundred percent reliability of technical systems cannot be guaranteed. FAIR FLY shall not be liable for system failures in data centers, in internet services or in transmission facilities of infrastructure and network operators or any other hardware and/or software failure for which FAIR FLY is not responsible. This also applies to the inaccessibility of FAIR FLY in areas with poor Internet supply and applies in particular to all cases of force majeure, such as power failures, computer failures due to computer viruses, etc.

6. Place of jurisdiction
